Welcome to Shiply Logistics. These Terms of Service ("Terms") govern your use of our website and international shipping and logistics services. By using our services, you agree to these Terms in full. If you do not agree, please do not use our services.

1. Acceptance of Terms

By using Shiply Logistics's website, submitting a shipment, or making a payment through our platform, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you are using our services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

2. Our Services

Shiply Logistics provides international parcel and freight shipping services including: collection, transportation, customs clearance, and delivery. We act as a shipping broker and logistics coordinator, working with a network of trusted courier and freight partners worldwide. We reserve the right to choose the routing, method of transport, and carriers used for each shipment at our sole discretion.

3. Shipment Acceptance & Customer Obligations

By submitting a shipment, you confirm that:

• All information provided (addresses, contents, declared value) is accurate, truthful, and complete
• The contents are permitted for international shipping under all applicable laws in both origin and destination countries
• The shipment does not contain any prohibited or restricted items (see Section 4)
• You are the lawful owner of, or have full authority to ship, the contents of the package
• All applicable import duties, taxes, and fees will be paid in a timely manner
• Packaging is sufficient to protect the contents during normal handling and transit

Providing false or misleading information may result in shipment refusal, seizure by customs, return of goods, and/or legal liability. You are solely responsible for any consequences arising from inaccurate declarations.

4. Prohibited Items

The following items are strictly prohibited from all shipments. Submitting prohibited items may result in legal prosecution:

• Illegal substances, narcotics, controlled drugs, and precursor chemicals
• Firearms, weapons, ammunition, explosives, and related components
• Hazardous materials including flammable, corrosive, radioactive, or toxic substances
• Live animals (unless pre-arranged with special permits)
• Human remains or cremated ashes (without required documentation)
• Currency, bearer instruments, or negotiable documents
• Counterfeit, pirated, or infringing goods
• Child exploitative material of any kind
• Any items specifically banned by the destination country
• Perishable goods without appropriate temperature-controlled packaging

We reserve the right to inspect, refuse, hold, or return any shipment that we reasonably believe contains prohibited items, without liability to you.

5. Tracking & Delivery

We provide tracking information on a commercially reasonable, best-efforts basis. Tracking updates may be delayed in some international destinations due to connectivity or infrastructure limitations. Estimated delivery dates are projections only and are not guaranteed. We are not liable for any loss arising from reliance on tracking information or estimated delivery dates.

Delivery is considered complete when the package is delivered to the address provided, including delivery to a reception desk, building mailroom, or similar designated location. If no one is available at the time of delivery, our standard redelivery procedure will apply.

6. Payment Terms & Fees

All fees are due as specified in payment notifications issued during transit. By accepting our services, you agree:

• Shipping fees, customs duties, insurance premiums, storage fees, and other charges are your sole responsibility
• Failure to pay outstanding fees within the specified due date may result in your shipment being held or returned
• Storage fees accrue from the day after the standard holding period expires and continue daily until payment is received or the shipment is disposed of
• We reserve the right to dispose of uncollected or abandoned shipments after 60 days of accruing unpaid fees, in accordance with applicable law
• All payments are final once blockchain confirmation is received for cryptocurrency transactions

7. Customs, Duties & Import Regulations

International shipments may be subject to customs duties, import taxes, and fees imposed by the destination country's government. You acknowledge and agree that:

• These charges are entirely your responsibility as the recipient/importer and are separate from our service fees
• We are not responsible for calculating, predicting, or covering customs duties on your behalf
• We may be required to disclose shipment information to customs authorities as required by law
• We are not liable for delays, losses, or additional charges caused by customs inspections or holds
• Undervaluing declared goods or providing false customs declarations is illegal and may result in seizure, fines, and criminal liability

8. Liability & Limitations

Our liability to you is limited as follows:

• We are not liable for delays caused by customs authorities, weather, natural disasters, civil unrest, strikes, or any circumstances beyond our reasonable control
• Basic liability for lost or damaged shipments is limited to the lower of the declared value or our standard maximum liability per shipment
• We are not liable for consequential, indirect, incidental, special, or punitive damages of any kind
• Our total aggregate liability to you for any claim shall not exceed the total fees paid to us for the specific shipment giving rise to the claim
• We are not liable for loss or damage resulting from prohibited or improperly packaged items
• We do not accept liability for delays attributable to inaccurate information provided by you

9. Insurance & Claims

Basic liability coverage is included with all shipments. Enhanced insurance is available as an optional add-on. All claims must be submitted through our support system within the following timeframes:

• Damage claims — within 48 hours of delivery
• Loss claims — within 14 days of the expected delivery date
• Late claims — will not be accepted under any circumstances

Claims require: tracking number, proof of value (receipts/invoices), photographic evidence (for damage), and a detailed description of the incident. We reserve the right to investigate all claims and our decision on compensation is final, subject to applicable law.

10. Intellectual Property

All content on our website, including text, graphics, logos, icons, images, and software, is the exclusive property of Shiply Logistics or its licensors and is protected by applicable copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written consent.

11. Privacy

Your use of our services is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your data as described in our Privacy Policy.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the revised Terms on our website with an updated effective date. Your continued use of our services after the effective date of any revision constitutes your acceptance of the revised Terms. If you do not agree to revised Terms, you should discontinue use of our services.

13. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without notice, for conduct that we determine in our sole discretion violates these Terms or is harmful to other users, us, third parties, or for any other reason. Termination does not relieve you of any outstanding payment obligations.

14. Governing Law & Disputes

These Terms are governed by and construed in accordance with applicable international commercial law and the laws of the jurisdiction in which our principal place of business is located. Any dispute arising from these Terms or our services shall first be addressed through good-faith negotiation. If unresolved, disputes shall be referred to binding arbitration or the courts of the applicable jurisdiction. You agree to attempt informal resolution before initiating formal proceedings.
